The protective framework of Law 57/1968 and current Law 20/2015

Law 57/1968 established a special regime for advance payments made in connection with the construction and sale of homes. Its purpose was unequivocal: to prevent the buyer from bearing the consequences of a failed development after paying funds before delivery of the property.

Special account, guarantee and bank oversight

The system was built around three elements: payment of the sums into a special account, allocation of those funds to construction, and protection by means of a bank guarantee or insurance policy. The financial institution opening or managing the account was required to ensure that the statutory guarantee existed, thereby placing the bank within the buyer-protection framework.

Evolution of case law

Spanish Supreme Court case law has interpreted the legislation in accordance with its protective purpose. The institution’s liability does not depend solely on the formal existence of an account labelled as a special account, but on the circumstances showing that the bank knew of the developer’s activity and the origin of the payments.

Issues that remain disputed

Debate remains over the identification of individual payments, proof of the bank’s knowledge, the treatment of certain forms of financing, time limits for claims and the effect of contractual amendments. These issues require a precise analysis of the documentation and of the case law applicable to the particular circumstances.

Conclusion

The doctrine now provides a considerably clearer framework than it did a decade ago. Its application, however, is not automatic. The strength of each claim depends on the traceability of the payments, their connection with the development, the communications available and the correct identification of the institution that received or controlled the funds.
