Sir Geoff Hurst – Deposit Recovery Case

One of our most notable cases involved Sir Geoff Hurst, the former England international footballer and 1966 World Cup winner.

Sir Geoff Hurst entrusted our firm to recover a substantial investment lost after purchasing a property in Marbella, where the developer later entered insolvency proceedings.

Our legal team pursued action against the bank involved in the development and, following a complex legal process, successfully recovered not only the full amount invested but also significant interest.

Sir Geoff Hurst commented:

The case was conducted together with five additional clients, all British and Irish, all of whom achieved a successful outcome.

What happens if

something goes wrong?

In Spain, a property development may:

  1. Never be built (failed development)

  2. Be delayed indefinitely due to:

• Lack of financing 

• Urban planning licenses or land issues

• Developers declaring bankruptcy / insolvency proceedings

• Poorly managed housing cooperatives 

 

In these situations, Spanish law may establish joint liability between the developer and the bank, allowing buyers to claim back the amounts paid, plus interest.

What if the property is delivered with defects? Even if the property is delivered, buyers may face:

• Construction defects
• Structural issues
• Properties that do not match agreed specifications

This is a very common situation and there is the possibility to bring claims against the developer and other parties involved in the construction, as well as against the relevant insurers.
